TERMS OF SERVICE

In accordance with Articles 13 and 27 of the Law on Consumer Protection (Official Gazette of the Republic of Serbia No. 62/2014), the company NK FIT & BEAUTY LLC NOVI SAD hereby provides to its valued customers who conduct online purchase of goods via the website www.nudeandrude.rs, the following

- Online sale of goods through the website www.nudeandrude.rs is conducted as part of the registered business activity of the company NK Fit & Beauty LLC, Novi Sad, with its registered office at Krilova 1, Novi Sad, Serbia; Company Registration No. 21574813; Tax Identification No. (PIB): 111932535; Telephone: +381 64 1462808; www.nudeandrude.rs, Complaints email address: info@nudeandrude.rs;

- Basic characteristics of the goods can be found at the website www.nudeandrude.rs;

- According to the Law on Customer Protection (Official Gazette of the Republic of Serbia No. 62/2014), online purchasing via our website www.nudeandrude.rs is considered distance selling;

- Any product sold via the website www.nudeandrude.rs possesses all the properties necessary for regular use of that type of product, in accordance with its purpose as defined on the product Label;

- Product conformity is determined EXCLUSIVELY according to the properties and purpose of the product as specified on the accompanying Label;

- Sales price is specified for each product - see more below, in the Price Of Goods section;

- The service of delivery of goods is charged for all orders, unless otherwise indicated;

- We deliver the purchased goods within 2-5 working days via courier service in a manner described below in the Terms Of Delivery section;

- Discounts and promotional offers (deals) are governed by the terms published on the website www.nudeandrude.rs;

- The Consumer can pay the goods purchased through the website www.nudeandrude.rs online by payment cards, cash on delivery, a payment order given to a post office or a bank or via e-banking. Each type of payment is described below in the Payment Methods section;

- By clicking on the COMPLETE PURCHASE button when creating an order, the Consumer undertakes to pay for the ordered goods;

- If, upon delivery of the ordered product, the Consumer determines that she/he wants to exchange it for another item of a higher, equal or lower price, she/he may do so within 14 days in the manner defined below in the Item replacement section;

- If, upon delivery of the ordered product, the Consumer does not want to keep it, she/he has the right to cancel the purchase contract and is entitled to a refund amounting to the price paid for the product, within 14 days in the manner defined below in the Right Of Withdrawal / Refund section;

- The Consumer is entitled to file a complaint regarding the goods ordered through the ONLINE store, even if the Consumer has started using it. The manner and procedure of filing complaints concerning the goods purchased in the ONLINE store is described below in the Complaints section.

 

PRICE OF GOODS

The price of an individual item can be found under the item overview, on the item page and in the basket. VAT is included in the price of the individual item.

The price of the item that was visible at the time of purchase is valid. All prices are current and regularly updated.

The availability and prices of products on the website www.nudeandrude.rs are subject to change due to a variety of factors such as typographical errors, incorrectly displayed prices or products being out of stock. In case of an incorrectly stated price, we will try to correct it as soon as possible.

 

TERMS OF DELIVERY

Where do we deliver the goods?

The products are shipped worldwide. We deliver ordered products with the payment option of cash on delivery only on the territory of the Republic of Serbia. Delivery of products for all other locations in the world is possible, but with a purchase made by payment cards via the website or payment via payment slip or invoice.

Delivery time

Once you have completed your order by clicking the "Complete purchase" button, you will automatically receive a confirmation email about the successful purchase, sent to the email address you provided when you were filling out the form. Thus, your order is being processed and will be sent. You can expect delivery within 2-5 working days (for orders in the territory of the Republic of Serbia). You can expect deliveries to other countries within 1 to 2 weeks (not counting potential customs delays).

You will only be contacted by our support service if there are any problems related to your order.

Delivery time for orders in the Republic of Serbia is 2-5 working days, weekends (Saturday and Sunday) do not count.

Package delivery

Courier delivers packages to the delivery address in the period from 8-19h. Delivery can depend on the time zone and your local post. If the courier does not find you at the address, the shipment will return to us. Upon receiving of the shipment, we will contact you to determine the reason why the shipment isn't delivered and agree to resend it.

Delivery Price

The delivery price for all orders depends on the delivery location as well as the value and weight of the purchased products.

 

PAYMENT METHODS

Payment by cards

You can pay for your order with the following payment cards: Visa, Visa Electron, MasterCard, Amex or Maestro. Your payment card must be approved for online (Internet) payments by the issuing bank.

After confirming the order, you will be redirected to the CorvusPay card payment system, where you’ll enter data from the payment card and make payments. If the transaction is successful, you will be redirected to the page with the information that the payment was made successfully. In the event of a failed payment, you will be redirected to our payment failure information page.

NK Fit & Beauty LLC uses an advanced system for secure acceptance of payment cards via the Internet, a payment card processor, Banca Intesa ad Belgrade and CorvusPay service for Internet payment of the company Corvus Info LLC.

CorvusPay ensures the complete confidentiality of your card data from the moment you enter it in the CorvusPay payment form. Payment data is forwarded encrypted from your web browser to Banka Intesa. Our store never comes into contact with complete information about your payment card. Also, the data is inaccessible even to CorvusPay system employees.

The form for entering payment data is provided with an SSL transport code of the highest reliability. All stored data is additionally protected by encryption, using a cryptographic device of a certified system according to the FIPS 140-2 Level 3 standard. CorvusPay meets all the requirements related to the security of online payments prescribed by leading card brands, i.e. operates in accordance with the standard - PCI DSS Level 1 - the highest security standard of the payment card industry. When paying with cards included in the 3-D Secure program, your bank, in addition to the validity of the card itself, additionally confirms your identity using a token or password.

When entering payment card data, confidential information is transmitted via the public network in a protected (encrypted) form using SSL protocols and PKI systems, which is currently the most modern cryptographic technology. Data security during the purchase is guaranteed by the payment card processor, Banca Intesa ad Belgrade, so the complete billing process is performed on the bank's website. Payment card information is not available to our system at no time.

Cash on delivery

We offer you the option of cash on delivery (direct payment to the courier at the delivery address) for purchases in the Republic of Serbia. In this case, after confirming the order, the goods will be sent to you by courier service, and you will pay the courier upon delivery.

Payment by payment slip or transfer of funds directly to the account

Payment by payment slip means that you can pay for your order by direct payment at any post office or bank, and transfer of funds means that you can make a payment by transferring funds from your account if you are a user of electronic banking. After payment, please send a picture of the payment slip or order to info@nudeandrude.rs. After processing your payment, the goods will be sent to the selected delivery address.

Conversion statement

All payments will be effected in Serbian currency – dinar (RSD).

The amount your credit card account will be charged for is obtained through the conversion of the price in Euro into Serbian dinar according to the current exchange rate of the Serbian National Bank. When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion, there is a possibility of a slight difference from the original price stated in our website.

Item replacement

If after receiving the item you ordered you found that you want to replace it with another item of the same or higher price category, please contact us at +381 64 14 62 808 or send us an email at: info@nudeandrude.rs with your order number, item code which you want to replace and the code of the item for which you want to replace the originally ordered item.

After that, we’ll perform a physical check of the availability of the desired item, after which you will receive instructions to your email address where the entire process of replacing the item with another will be explained to you.

The ordered item cannot be exchanged if it has been used, that is when returning the goods, it is obligatory to return it in the same condition you received it in, in an originally undamaged packaging.

After the application for item replacement, it is necessary to adequately pack the goods and send them by courier service, together with the printed, filled out documentation that you received to the e-mail address after you sent the request for item replacement. As soon as the original goods reach our company, a replacement item will be sent to you.

Replacement deadline

The deadline for replacing the item is 14 days from the moment the customer submits the request, and after receiving the product.

Shipping costs

The costs of replacing goods and money are borne by the buyer, except in cases where the buyer receives a defective or incorrect item. If the buyer made a mistake when choosing the item, when taking over the goods, the buyer pays the amount of one postage according to the official price list of the courier service. You pay the postage in cash to the courier who will pick up the goods for replacement.

NOTE: By confirming the order and clicking on the COMPLETE PURCHASE button, you agree to the terms of exchanging the item for another.

Right Of Withdrawal / Refund

Dear Buyers, please be informed that according to the Law on Consumer Protection (Official Gazette of the Republic of Serbia No. 62/2014), online shopping through our website www.nudeandrude.rs is considered distance selling.

In the case of distance selling, the Law provides for the right of the Buyer, who is considered the Consumer (i.e. a natural person who purchases a product for her/his individual needs, rather than for conducting a professional activity), to cancel the purchase contract within 14 days of delivery of the product. When canceling the order, the Buyer may, but is not obliged to, state the reason for cancellation.

The Contract Cancellation Form/Statement produces legal effects as of the day it was sent to the Trader.

You can download the Contract Cancellation Form/Statement here. After fulfilling the form, it‘s necessary to send it scanned to info@nudeandrude.rs.

In the case of canceling the contract, the Consumer is entitled to a refund or exchange for another product. The price amount will be returned to the Buyer upon receipt of the product and after we have confirmed that the product is not damaged or defective.

The Buyer is obliged to return the product without delay, and no later than 14 days after she/he sent the Cancellation Form. It is not possible to return the product upon expiry of the period of 14 days from the day the Cancellation Form was sent.

The goods are to be returned in a proper condition, unused, in their original package, and accompanied by the invoice/dispatch note the Buyer received with the order.

Upon receipt of the product, it will be determined whether the product is in the proper condition and unused. The Buyer is responsible for any defects or damage to the product caused by improper handling; specifically, the Buyer is solely responsible for any reduced value of the goods caused by improper handling of the product, i.e. by handling the product in a manner exceeding what is necessary to determine its nature, properties and functionality. If it is established that there is a defect or damage to the product for which the Buyer is responsible, we will not be able to refund the purchase price and the product will be resent to the Buyer at the Buyer’s expense.

The Trader is obliged to refund the amount paid by the Buyer under the contract without delay, and no later than 14 days after receiving the Cancellation Statement and upon return of the product.

Return and refund costs will be borne by the Buyer, except in cases where the Buyer has received a defective or wrong item.

In case of returns or refunds concerning the goods paid for by the Buyer with a payment card, in whole or in part and regardless of the reason for return, the nudeandrude.rs is obliged to effect the refund exclusively through the VISA, EC/MC, and Maestro payment methods. This means that at the Seller’s request the relevant bank will conduct the refund to the bank account of the card holder.

 

COMPLAINTS

When receiving your shipment, please inspect your package in the presence of the courier. If there are visible signs of damage (torn parts or dents), you should not accept the package. In that case, please call us at +381 64 14 62 808 or email us with your details (name, surname, telephone number) at info@nudeandrude.rs and specify the reason why you refused the delivery. We will contact you shortly with further instructions.

If you have received the shipment and discovered, upon opening the package, that the delivered goods do not match those ordered or that the details on the invoice are incorrect, please contact us within 24 hours of receipt of the package at +381 64 14 62 808 or email us with your details (name, surname, telephone number) at info@nudeandrude.rs and describe the problem. We will respond by post or email as soon as possible, in any case no later than 8 days from receipt of the complaint, and inform you on further steps. Complaints are to be resolved within the period of 14 days of receipt thereof. 

If non-conformities appear in the sense of the provisions of the Consumer Protection Act on the purchased product, please inform us at info@nudeandrude.rs or by contact phone +381 64 14 62 808.

In the case of returning the goods to the buyer who previously paid the goods to the courier, ie. cash on delivery, the costs of returning the goods are not borne by NK Fit & Beauty LLC but the cost falls on the customer.

We collect only the necessary, basic data on customers / users and necessary data for doing business and informing users in accordance with good business practices and in order to provide quality service. Registration on www.nudeandrude.rs implies the user's consent to send her/him email and/or sms notifications. We give customers a choice including the ability to decide whether or not to delete their names from mailing and sms lists used for marketing campaigns.

NK Fit & Beauty LLC will use your personal details only for the purpose of technical administration of our website, in order to provide you with access to specific information or to enable communication with you. NK Fit & Beauty will not market or sell the information in its possession to third parties. NK Fit & Beauty’s employees are obliged to respect the privacy of your information.

We will never misuse your private information in any manner.
We will not surrender your contact details to any third party, except where obliged to do so under the law.

In addition to the above information, we collect, analyze and process data about the products our visitors browse and buy, and the pages they visit. We use this data to improve our offer and webpage design, and to ensure easier, safer, and more comfortable shopping for you.
